ABSTRACT: This note considers regulatory incoherence. The focus is on the development of inconsistent approaches to worker rights to refuse hazardous work. The Note first reviews the present state of the law affecting the right to refuse hazardous work under the federal labor laws and the OSHAct regulations. The Note then analyzes the problems that result from this multi-standard, multi-forum scheme. It argues that harmonization of statutory standards is required under the law and that one unified national standard should be adopted–the standard under the OSHAct regulations.
